Legal Support of State Registration of Commercial Real Estate Assets in the Republic of Belarus and the Ways of Its Enhancement

High level of the commercial real estate market development, which largely contributes to the implementation of one of the basic principles of the market economy – individual isolation and freedom of economic activity of economic agents is one of the essential conditions for the effective functioning of the economy on a national scale. The article substantiates the role of the state as the main subject of regulation of the real estate market and investigates, in particular, the legal support of the state registration of commercial real estate property in the Republic of Belarus. In accordance with the author's concept of «commercial real estate market», the highlighted features of this market introduce the concept of «subject structure of the commercial real estate market», which is formed by means of combining diverse subjects of the commercial real estate market, taking into account the system of relationships between them, summarizing their goals, objectives, economic interests, methods and forms of organization and interaction concerning the movement of commercial real estate assets at different stages of the life cycle. Each element of the five blocks of the subject structure of the commercial real estate market of the Republic of Belarus is identified. The concept of «mechanism of state regulation of the real estate market» is given. The methods of direct administrative and economic regulation of the commercial real estate market are highlighted. The system of state organizations in the field of state registration in the Republic of Belarus is shown. The system of state registration of real estate in Belarus is considered, its goals are specified. The analysis of the current system of state registration allowed to highlight its shortcomings, which was the basis for the development of ways of its enhancement, including the use of GIS-technologies. The necessity to introduce such an innovative tool as the technical and economic uniform passport of the commercial real estate property is substantiated. Одним из неотъемлемых условий эффективного функционирования экономики в национальном масштабе является высокий уровень развития рынка коммерческой недвижимости, что во многом способствует реализации одного из основных принципов рыночной экономики – индивидуальной обособленности и свободы хозяйственной деятельности экономических агентов. В статье обоснована роль государства как основного субъекта регулирования рынка недвижимости и, в частности, изучено состояние правового обеспечения государственной регистрации объектов коммерческой недвижимости в Республике Беларусь. В соответствии с авторским понятием «рынок коммерческой недвижимости», выделенными особенностями этого рынка введено понятие «субъектная структура рынка коммерческой недвижимости», которая сформирована с позиции объединения разнофункциональных субъектов рынка коммерческой недвижимости, учитывая систему взаимоотношений между ними, обобщающая их цели, задачи, экономические интересы, способы и формы организации и взаимодействия по поводу движения объектов коммерческой недвижимости на разных стадиях жизненного цикла. Идентифицирован каждый элемент из пяти блоков субъектной структуры рынка коммерческой недвижимости Республики Беларусь. Дано понятие «механизм государственного регулирования рынка недвижимости». Выделены методы прямого административного и экономического регулирования рынка коммерческой недвижимости. Показана система государственных организаций в области государственной регистрации в Республике Беларусь. Рассмотрена система государственной регистрации объектов недвижимости в Республике Беларусь, конкретизированы ее цели. Проведенный анализ действующей системы государственной регистрации позволил выявить ее недостатки, что выступило основанием разработки направлений совершенствования процесса, в том числе с использованием ГИС-технологий. Обоснована необходимость введения инновационного инструмента – технико-экономического единого паспорта объекта коммерческой недвижимости.
